Terms and Conditions
These terms and conditions (the “Terms and Conditions“) govern the use of www.magnificat.coop (the “Site“) services (the “Services“), applications, tools or messaging (collectively, our “Platforms”). Our Site and Platforms are owned and operated by Magnificat Central Credit Cooperative (“MCCC”).
By visiting or interacting with our Platforms, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.
THESE TERMS AND CONDITIONS CONTAIN A DISPUTE RESOLUTION CLAUSE THAT IMPACTS YOUR RIGHTS ABOUT HOW TO RESOLVE DISPUTES. PLEASE READ IT CAREFULLY.
Intellectual Property
All content published and made available on properties of Magnificat Central Credit Cooperative and its creators are owned by Magnificat Central Credit Cooperative and its creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Platforms. You may not use, reproduce, or distribute any content from our Platforms without prior written consent.
Acceptable Use
As a user of our Platforms, you agree to use our Platforms legally and responsibly. Prohibited activities include, but are not limited to:
- Harassing or mistreating other users.
- Violating the rights of other users.
- Infringing upon the intellectual property rights of our Platforms owners or any third party.
- Attempting to gain unauthorized access to other users’ accounts.
- Engaging in fraudulent activities.
- Posting or sharing inappropriate or offensive content.
- Distributing computer viruses or other harmful software.
If we believe you are using our Platforms illegally or in a manner that violates these Terms and Conditions, we reserve the right to limit, suspend or terminate your access to our Platforms. We also reserve the right to take any legal steps necessary to prevent you from accessing our Platforms.
User Contributions
Users may post the following information on our Platforms:
- Items for sale;
- Photos;
- Videos; and
- Public comments
When posting content on our Platforms, users must adhere to the following guidelines:
- Content must be relevant and appropriate for the intended audience.
- Users are responsible for the accuracy and legality of their contributions.
- Offensive, discriminatory, or illegal content will not be tolerated.
- Users must respect the intellectual property rights of others.
- MCCC reserves the right to remove any content that violates these guidelines.
Content Usage
Users must adhere to the following guidelines when posting or sharing content on our Platforms:
- Ensure that all content shared on the Platforms is accurate, truthful, and does not infringe upon the rights of others, including intellectual property rights.
- Respect the privacy of others and refrain from sharing personal or sensitive information without consent.
- Abide by any additional content guidelines or restrictions provided by MCCC, including restrictions on the use of offensive or inappropriate content.
Accounts
When you create an account on our Platforms, you agree to the following:
- You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and
- All personal information you provide to us through your account is up-to-date, accurate, and truthful and that you will update your personal information if it changes
We reserve the right to suspend or terminate your account if you are using our Platforms illegally or if you violate these Terms and Conditions.
Sale of Goods and Services
These Terms and Conditions govern the sale/use of goods and services that we provide.
Payment for goods and services must be made in full at the time of purchase unless otherwise stated or agreed upon.
These Terms and Conditions apply to all the goods and services that are displayed on our Platforms at the time you access it. This includes all products listed as being out of stock. All information, descriptions, or images that we provide about our goods and services are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods and services we provide. You agree to purchase goods and services from our Platforms at your own risk.
Prices and availability of products are subject to change without notice. MCCC and the merchants reserve the right to modify, reject or cancel your order whenever it becomes necessary. Transactions you have with a merchant shall be subject to such merchant’s terms and conditions, including terms and processes for purchase, return, and refund. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund. Refunds are available for eligible goods and services, as outlined in our Refund Policy.
Third-Party Goods and Services
Our Platforms may offer goods and services from third parties. We cannot guarantee the quality or accuracy of goods and services made available by third parties on our Platforms.
Merchant Goods and Services
Our Platforms allow merchants to sell goods and services. We do not assume any responsibility for the goods and services merchants sell on our Platforms. We cannot guarantee the quality or accuracy of any goods and services sold by merchants on our Platforms. However, if we are made aware that a merchant is violating these Terms and Conditions, we reserve the right to suspend or prohibit the merchant from selling goods and services on our Platforms.
Payments
We accept the following payment methods on our Platforms:
- Major Credit Cards (Master Card, Visa, AmEx, etc.);
- Debit and Debit Credit Cards;
- PayPal; and
- Bank ACH
When you provide us with your payment information, you authorize our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorize us to charge the amount due to this payment instrument.
If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.
Refunds
Refunds for Goods and Services
Refund requests must be made within 30 days of receipt of your goods or services.
We accept refund requests for goods sold on our Site for any of the following reasons:
- Goods damaged;
- Good does not match description;
- Good is the wrong size;
- Purchaser changed their mind; or
- Services does not meet the purchaser’s expectations.
Refunds do not apply to the following goods:
- sale items;
- final sale, etc.
Refunds from Merchants
Transactions you have with a merchant shall be subject to such merchant’s terms and conditions, including terms and processes for purchase, return, and refund.
Service Provisions
MCCC agrees to provide the following services to users in accordance with these Terms and Conditions:
- Access to the Platforms and their associated features and functionalities, subject to compliance with these Terms and Conditions.
- Technical support and assistance as needed to ensure the proper functioning of the Platforms and resolution of any issues or concerns.
- Regular updates and maintenance to the Platforms to ensure optimal performance and security.
Service Limitations
MCCC reserves the right to impose certain limitations or restrictions on the use of its services, including but not limited to:
- Restrictions on the availability of certain features or functionalities based on user eligibility or compliance with specific requirements.
- Limits on the frequency or volume of use of certain services to prevent abuse or misuse.
- Suspension or termination of services for users who violate these Terms and Conditions or engage in prohibited activities.
Modifications to Services
MCCC reserves the right to modify or discontinue any services offered through the Platforms at any time, with or without notice, including the addition or removal of features or functionalities. Users acknowledge and agree that MCCC shall not be liable for any such modifications or discontinuations.
Consumer Protection Law
Where the Business Practice and Consumer Protection Act, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.
Links to Other Websites
Our Site and Platforms contain links to third-party websites or services that we do not own or control. We are not responsible for the content, policies, or practices of any third-party website or service linked to our Platforms. It is your responsibility to read the terms and conditions and privacy policies of these third-party websites before using these sites.
Limitation of Liability
Magnificat Central Credit Cooperative and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site and Platforms.
Indemnity
Except where prohibited by law, by using our Site and Platforms, you indemnify and hold harmless Magnificat Central Credit Cooperative and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site and Platforms or your violation of these Terms and Conditions.
Applicable Law
These Terms and Conditions are governed by the laws of the Province of British Columbia, Canada.
Dispute Resolution
Subject to any exceptions specified in these Terms and Conditions, if you and Magnificat Central Credit Cooperative are unable to resolve any dispute through informal discussion, then you and Magnificat Central Credit Cooperative agree to submit the issue first before a non-binding mediator and to an arbitrator in the event that mediation fails. The decision of the arbitrator will be final and binding. Any mediator or arbitrator must be a neutral party acceptable to both you and Magnificat Central Credit Cooperative.
Notwithstanding any other provision in these Terms and Conditions, you and Magnificat Central Credit Cooperative agree that you both retain the right to bring an action in small claims court and to bring an action for injunctive relief or intellectual property infringement.
Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Any invalid or unenforceable provisions shall be replaced with valid and enforceable provisions that achieve the same objectives to the extent possible.
Changes
These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.
